  1. We have tried to keep our small print to a minimum, however there are some important things we need you to agree to. These may change from time to time, but we promise to keep you informed. The terms in effect at the time you place your order will apply, together with any changes that we make subsequently, so long as they do not reduce any of your contractual rights.
  2. Please read these terms carefully before you place an order with us. These terms tell you who we are, how we will provide products to you, how we may change or end the contract and what to do if there is a problem.
  3. We only serve consumers making purchases for domestic and private products. You must not use our site for any business purpose, and we will not be liable to any business for any loss of profit, revenue, business or business opportunity, or any business interruption.
  4. The Muse is our retail space within the grounds of Estelle Manor. Estelle Manor is a ‘hosted home’ in the countryside, bringing people together that have plenty to say and nothing to prove.
  5. Estelle Manor is a proprietary Club residing in North Leigh, Witney OX29 6PN, the proprietor of which is Estelle Manor Ltd (“the Company”). The Company is a private company incorporated in England & Wales with company number 11258257.

If we need to contact you about your order, we will use the email address, postal address and/or telephone number you provided when you made your order. We only use your personal information in accordance with our Privacy Policy. The contract between us

  1. You must be at least 18 years of age to place an order.
  2. When you submit an order, you will receive an acknowledgement of receipt (“Order Receipt”). This Order Receipt is not our acceptance of your order; it is confirmation we have received your order. We typically accept orders when we are ready to dispatch them, at which point we will send you a confirmation of order (“Dispatch Confirmation”). The contract between us will only be formed when we send you the Dispatch Confirmation. Only goods dispatched will be included in the contract.
  3. If we are unable to accept your order (which is at our discretion for any reason whatsoever), we will inform you of this and will not process your order or charge you. If applicable, we will refund any amount you have already paid us. We make every effort to avoid this, but sometimes we may find that we are unable to source stock, we have identified an error in the price or description of the product, or we are unable to meet a delivery deadline.
  4. Your Order Receipt will contain a unique order number. It would be helpful if you could quote this if you need to contact us about your order.
  5. All orders are subject to acceptance and availability. On placing an order you undertake that you are at least 18 years old, that all details you provide to us are true and accurate, that you are an authorized user of the payment method used to place your order and that there are sufficient funds to cover the cost of the goods.
  6. By placing an order through the our website, you confirm that you have read and understood these terms and our Privacy Policy in their entirety and you agree to be bound by them. If you refuse to accept these terms, you will not be able to order any goods from our website.

 

Our products

  1. Our products may vary slightly from the pictures on our website. As many of our products are handmade, there might be small variances between products.
  2. Although we have made every effort to be as accurate as possible, sizes, weights, capacities, dimensions and measurements may differ slightly between manufacturers.

 

Delivery

  1. The costs of delivery will be displayed to you on our website.
  2. Your estimated delivery date will be stated in your Dispatch Confirmation. This date will be within 30 days of the day on which we accept your order.
  3. We are not liable or responsible for any failure to perform, or delays in performance for Events Outside Our Control. An “Event Outside Our Control” includes, but is not limited to, any act or event beyond our reasonable control, including without limitation: strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, severe weather conditions, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster, adverse weather conditions, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
  4. If our supply of the products is delayed by an event outside of our control, we will take steps to let you know as soon as possible and to minimise the effects of the delay. Provided we do this, we will not be liable for the effects of the delay. However, if there is a risk of a significant delay, you may contact us to end the contract and receive a refund for any products you have paid for but not received.
  5. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations.
  6. If you have asked to collect items from our store, you may only enter the grounds if you are a guest of the hotel, or a member of Estelle Manor. Collections from The Muse can be made during our normal working hours which are displayed on our website. We will email you when your order is ready for collection.
  7.  7.If you are not at home when the product is delivered, our courier will leave a note informing you of how to rearrange delivery or collect the products from a local depot. If you do not rearrange delivery or collect the products after a reasonable time, we will contact you for further instructions and may charge you for storage and further delivery costs.
  8. The checkout section of our website explains which overseas countries we can ship to. This can vary from product to product. If you order products from our site for delivery overseas, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount. You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order. You must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable or responsible if you break any such law.

  10. You own the products once we have accepted your order and we have received payment in full. You are responsible for the products when we deliver them to the address that you have provided.
  11. All tax charges are based on state and local tax laws and tax rates for the shipping address you have supplied. All tax charges will be displayed on the checkout page and are not included within the product cost. If you return an item for a refund, you will also receive a refund for the taxes that were applied to that item. Where required, tax will also be applied to shipping and handling costs, please note you will not receive a refund for taxes against shipping costs once the order has been shipped.

 

If you’ve changed your mind

  1. You have a right to return products or end the contract in the following circumstances:
    A) You have a right to change your mind about products bought online within 14 days.
    B) If what you have bought is not as described, not fit for purpose or of unsatisfactory quality.
    C) You can also end the contract before we have issued a Dispatch Confirmation, if we have told you about an error in the price or description of the product you have ordered and you no longer wish to proceed, or if we have told you that there may be a significant unexpected delay in delivering your order. You are entitled to a ‘cooling off’ period of 14 days after you have received the delivery of your product. To tell us you wish to change your mind, please contact us using the contact details on our website. You must return the products to us, at the address shown in the Dispatch Confirmation. The products must be sent off to us within 14 days of telling us that you wish to end the contract.
  2. Items should be returned unused and in a resalable condition, with all garment tags and care labels still attached. If returned items do not match the items included in the original order or are damaged or soiled we reserve the right not to accept them and may send them back to you and/or refuse a refund.
  3. For hygiene reasons swimwear and underwear must be unused with the tags and hygiene seals intact, and in the complete original packaging, unless they are faulty. These goods should not be tried on and must be inspected in their packaging.
  4. We will refund you the price you paid for the products to the original method you used for payment. Please note that:
    A) we are entitled to make a deduction if the value of the products has been reduced by you handling them in a way which would not be permitted in a shop.
    B) we will also refund the delivery costs, but this will be limited to the lowest price delivery option. We will not refund any additional amount paid for expedited delivery. You are responsible for the costs of returning the items to us.
  5. Your refund will be made within 14 days of the day on which we receive your products back or, if earlier, the date on which you provide evidence that you have sent them back to us.

 

Refunds for faulty products

  1. You have legal rights if products are not as described, not fit for purpose or not of satisfactory quality (faulty). Nothing in these terms will affect your statutory legal rights.

  3. To reject your products because they are faulty, please contact us using the contact details on our website. You will need to post the products back to us. We will pay for the cost of postage.

 

Price

  1. The price of your product (including VAT) will be the price indicated on the order pages when you placed your order. We take reasonable care to ensure that the price advised to you is correct. However, it is always possible that, despite our efforts, some products we sell may occasionally be incorrectly priced.
  2. If your product’s correct price at your order date is higher than the price stated to you, we will contact you for instructions before we accept your order.
  3. If we accept and process your order where a pricing error is obvious and could reasonably have been recognised by you as a mispricing, we may end the contract, and refund any sums you have paid for products which you have not received.
  4. You must pay for products before we dispatch them. We will not charge your payment method until we dispatch the products to you.

 

Our responsibility to you for loss

  1. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, such as if you discussed it with us during the order process.
  2. We do not exclude or limit our liability to you where it is not permissible by law to do so.

 

Disputes

In the unlikely event that there is a dispute in relation to the goods supplied, any dispute or claim shall be governed and construed according to laws of England and Wales and shall be subject to the exclusive jurisdiction of the English and Welsh Courts. If any provision of these Terms & Conditions is held by any Court or other authority to be invalid or unenforceable in whole or in part, then the validity of the rest of these Terms & Conditions and the remainder of the provision in question shall not be affected thereby.
